Pilots.social Limited ("Pilots.social", "we", "us", or "our") is committed to handling personal information in a transparent, lawful, and secure manner.

1. Scope of This Privacy Policy

This Privacy Policy explains how we collect, receive, use, store, disclose, protect, retain, and otherwise handle personal information in connection with our website, our digital marketing and related services, our client onboarding, communications, billing and support activities, our affiliate program, and our use of third-party platforms, tools, software, white-label systems, and service providers used to deliver our services.

This Privacy Policy is based on the New Zealand Privacy Act 2020. We are based in New Zealand and comply with the New Zealand Privacy Act 2020. Other privacy or data protection laws may apply depending on factors such as the location of individuals, the nature of the services provided, and how our services are used. This policy does not necessarily address those laws in full. If you are located outside New Zealand and wish to understand how those laws may apply to you, please contact us.

By using our website, engaging our services, applying to participate or participating in our affiliate program, communicating with us, or otherwise interacting with us, you acknowledge that you have read and understood this Privacy Policy.

2. What This Policy Does Not Cover

This Privacy Policy does not govern third-party websites, software, tools, or services that have their own privacy policies; how a client uses personal information outside our services or outside systems we manage or provide; how an affiliate uses personal information outside our affiliate program or outside systems we provide or manage; or privacy practices of third-party platforms such as advertising platforms, hosting platforms, analytics tools, payment providers, white-label platform providers, or AI providers except to the extent we describe our relationship with them.

If you interact directly with a third party, their privacy practices may also apply.

3. Privacy Roles and Relationship Structure

Depending on the context, Pilots.social may act in one or more different privacy roles.

3.1 When we collect and use personal information for our own purposes:

We generally collect and use personal information for our own business purposes, including where we process personal information for managing client and affiliate relationships, marketing our services, handling enquiries and support, administering our affiliate program, processing billing and payments, operating and improving our website, systems, and services, maintaining records, logs, and internal reporting, fraud prevention, risk management, and platform security, and legal compliance and enforcement of our terms.

3.2 When we handle personal information on behalf of our clients:

Where a client provides personal information to us and asks us to handle it on the client's behalf in connection with marketing services, automation, analytics, lead handling, or related service delivery, we may act as a service provider. In those cases, the client is generally responsible for determining the purposes for which that information is collected and used, and we handle that information in accordance with our obligations under applicable privacy laws.

3.3 Affiliate Program Context:

Our affiliate program may be operated directly by us and may also use third-party or platform-based tools for tracking, hierarchy management, reporting, commissions, and payouts. In the affiliate program context, we may collect, use, store and disclose personal information for administration of the affiliate program, affiliate onboarding, affiliate relationship management, communications, reporting, fraud prevention, and payout administration. Affiliate information may be visible to us, relevant service providers, and, where relevant, within certain permitted program or hierarchy views. Some affiliate and referral information may be processed by third-party systems or network/platform providers where needed to deliver the program.

3.4 Clients' Role:

Clients are responsible for their own privacy practices and legal compliance where they control personal information relating to their own leads, contacts, customers, campaigns, or systems including any collection, use, disclosure, or other handling of personal information outside our services or systems.

3.5 Affiliates' Role:

Affiliates are responsible for complying with privacy, anti-spam, direct marketing, disclosure, and related laws in connection with their own promotional activity, communications, websites, landing pages, outreach, and other business practices, including any collection, use, disclosure, or other handling of personal information carried out by them.

3.6 We operate across multiple jurisdictions and may support clients and affiliates in different countries. While we take reasonable steps to comply with applicable privacy laws that apply to us, we do not assess or determine whether any particular activity, campaign, or use of personal information is lawful in every jurisdiction. Clients and affiliates should ensure that their own collection, use, disclosure, and other handling of personal information complies with applicable laws in the jurisdictions relevant to their activities.

3.7 We do not control how clients or affiliates use personal information outside our services or systems, and their independent privacy practices are governed by their own policies and obligations.

4. Personal Information We Collect

We may collect, receive, generate, or otherwise process the following personal information. We will only collect personal information where it is reasonably necessary for the purposes set out in clause 6.

4.1 Contact and Identity Information:

This may include full name, display name, email address, phone number, postal or physical address, business name, company details, job title or role, billing contact details, and account login details or identifiers.

4.2 Client and Service Information:

This may include proposal and onboarding information, service selections and preferences, campaign information, project communications, account history, support history, approvals, instructions, feedback, and billing and invoicing records.

4.3 Marketing and Communications Data:

This may include marketing preferences, engagement with emails, campaigns, pages, advertisements, and content, survey responses, lead form responses, communication logs, support messages, and sales enquiry history.

4.4 Technical and Usage Data:

This may include IP address, browser type and version, operating system, device identifiers, language settings, pages visited, time spent on site, clickstream data, referrer URL, advertising engagement data, diagnostics and performance data, session data, and cookie and similar technology data.

4.5 Affiliate Program Information:

Where you apply to or participate in our affiliate program, we may collect or generate affiliate account and profile information, application details, acceptance records and terms acceptance history, referral link, code, and attribution records, clicks, sign-ups, and conversion records, commission records, payout records, dispute records, fraud review data, hierarchy or multi-tier placement information, and affiliate communications and support records.

4.6 Customer, Lead, and Referral Information:

Depending on how our services or affiliate program operate, we may process personal information relating to leads, prospects, customers, referred customers, contact records, transaction or order references, service subscription records, attributed referral relationships, and engagement or conversion information.

4.7 Financial and Payment Information:

We and our service providers may collect or process invoicing information, billing contact details, transaction records, payment status, payout recipient details, bank or transfer details processed by third-party providers, and tax or registration information where relevant. We do not usually store full card details ourselves where payment processing is handled by third-party processors.

4.8 Third-Party Source Data:

We may receive personal information from advertising platforms, analytics providers, automation tools, AI platforms, white-label platforms and platform providers, referral or affiliate platforms, industry partners or referral sources, publicly available sources, and clients who provide data for service delivery.

5. How We Collect Personal Information

We collect personal information directly from you when you contact us, use our site, engage our services, or join our affiliate program. We also collect your personal information automatically through our website, platforms, portals, analytics, cookies, and tracking technologies; from clients, affiliates, or referral sources; and from third-party service providers and integrations. Where we collect personal information other than directly from you (including from clients, affiliates, referral sources, or third-party platforms), we will take reasonable steps to ensure that you are made aware of the matters set out in Information Privacy Principle 3 of the Privacy Act 2020 (including the fact of collection, the purpose of collection, the intended recipients, and your rights of access and correction), unless an exception under the Privacy Act 2020 applies.

6. How We Use Personal Information

We use personal information for the following purposes for which it was collected, unless an exception applies under the Privacy Act 2020.

6.1 Service Delivery:

We may use personal information to provide digital marketing, consulting, automation, branding, reporting, analytics, and related services; onboard and manage client accounts; deliver and support campaigns; configure and operate service environments; and communicate about projects, deliverables, timelines, and support.

6.2 Sales and Marketing:

We may use personal information to respond to enquiries, send updates, newsletters, and promotional communications where permitted by law (including the Unsolicited Electronic Messages Act 2007 (for example, where consent has been obtained and an unsubscribe facility is provided)), perform lead generation and audience analysis, personalise marketing communications, and improve our marketing strategy and communications.

6.3 Analytics, Service Improvement, and Research:

We may use personal information and usage data to monitor website and campaign performance, improve user experience, improve tools, workflows, and internal processes, identify issues or inefficiencies, and evaluate service effectiveness and operational performance.

6.4 Affiliate Program Administration:

We may use personal information to onboard and manage affiliates, assess eligibility for the affiliate program, issue and manage affiliate links or codes, track referrals, conversions, and commissions, manage affiliate reporting and support, maintain hierarchy and multi-tier relationships where applicable, administer commission and payout processes, detect fraud, abuse, or prohibited activity, and communicate program updates, changes, or compliance matters. Information made available through affiliate, referral, or hierarchy features must not be used for unrelated marketing, contact harvesting, or establishing off-platform relationships except as permitted by applicable law.

6.5 Fraud Prevention, Security, and Integrity:

We may use personal information to protect our website, services, and affiliate program, detect unauthorised access or misuse, investigate suspicious activity, validate attribution, commission, and conversion integrity, monitor spam, abuse, fraudulent traffic, or deceptive activity, and maintain audit trails and security logs.

6.6 Legal, Administrative, and Compliance Purposes:

We may use personal information to comply with legal and regulatory obligations, maintain accounting, tax, and business records, respond to legal requests, disputes, or complaints, enforce our terms and policies, and preserve evidence for claims, investigations, or disputes.

6.7 AI and Automation:

We may use reputable third-party AI or automation systems to assist with generating or improving marketing assets, copy, ideas, drafts, summaries, and workflow outputs; analysing performance and recommending strategies; and improving service delivery and internal efficiency. We do not intend to use AI for automated decision-making that has legal or similarly significant effects on individuals in a standalone manner.

6.8 Aggregated, Anonymised, and De-Identified Data:

We may create, use, retain, disclose, and analyse aggregated, anonymised, de-identified, statistical, benchmark, and reporting data for service improvement, analytics, research, operational planning, product development, marketing, or business intelligence, provided that such data does not identify an individual except as permitted by law.

7. Affiliate Program Information Sharing

Where reasonably necessary to operate the affiliate program, we may disclose or make visible information such as affiliate name or display name, email address or contact details, program participation status, referral or tracking identifiers, performance metrics, attribution or conversion records, commission and payout-related information, hierarchy or multi-tier position information, and fraud, dispute, or compliance status where reasonably necessary.

Affiliate information may be shared with our internal personnel and contractors who administer the affiliate program, relevant platform or network providers who support program operation, payment or payout providers where needed for commission or payout processing, service providers who support fraud detection, analytics, support, or communications, other affiliates or hierarchy participants to the extent hierarchy visibility is a core and configured feature of the program, relevant clients or account administrators where reasonably necessary to administer referral relationships or program participation, and regulators, authorities, advisers, or legal counterparties where required by law or reasonably necessary for enforcement or dispute handling.

If the affiliate program includes hierarchy or multi-tier features, certain information may be visible within the hierarchy to support program administration, collaboration, reporting, attribution, performance tracking, and commission logic. This may include affiliate name or display name, contact information, join date, status, hierarchy position, referral identifiers, and performance metrics.

Where affiliate information is made available within the affiliate program, it must be used only for legitimate affiliate program purposes. It must not be used for unrelated marketing, contact harvesting, spam, or establishing or migrating relationships outside the Platform in a way that bypasses our systems or commercial arrangements.

8. Disclosure of Personal Information

We may disclose personal information to service providers and contractors, advertising and analytics platforms, payment and payout providers, white-label and platform providers, for legal and regulatory reasons, in connection with business transfers, and in aggregated or de-identified form where it does not reasonably identify any individual.

We do not sell personal information in the ordinary sense of that term. For some jurisdictions, certain advertising disclosures may be treated as "sharing" for targeted advertising purposes under local law. Where applicable, you may exercise available opt-out rights.

Where we disclose or transfer personal information outside New Zealand, we take reasonable steps to ensure that the recipient is subject to comparable privacy safeguards in accordance with information privacy principle 12 of the Privacy Act 2020, including by contractual or other appropriate safeguards where required.

9. Cookies, Tracking, and Advertising Technologies

We may use cookies, analytics tools, advertising pixels and tags, local storage, browser identifiers, session markers, and AI-assisted analytics or behavioural tools to analyse website traffic, improve performance and user experience, support attribution and conversion measurement, personalise content or marketing, conduct retargeting or audience analysis, and secure sessions and detect suspicious activity.

Where required by law, we provide or honour appropriate consent or opt-out controls for non-essential technologies.

10. Data Security

We take reasonable and industry-standard steps to protect personal information from unauthorised access, loss, misuse, alteration, or disclosure. These measures may include encryption in transit, restricted access controls, secure storage, password and authentication protections, monitoring and logging, staff confidentiality obligations, and internal policies and procedural controls.

No system is completely secure, but we work to reduce risk and respond appropriately to incidents.

11. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including to provide services, administer client relationships and affiliate relationships, comply with legal obligations, maintain business, tax, and accounting records, preserve evidence for disputes, investigations, or claims, maintain fraud prevention and security records, and support platform, system, or operational continuity.

Retention periods may vary depending on the type of data, legal requirements, and operational needs. When information is no longer required, we may delete it, anonymise it, or de-identify it where reasonably practicable.

12. Children's Privacy

Our services and affiliate program are not directed to children. We do not knowingly collect personal information from children below the age thresholds that apply under relevant law. If you believe a child has provided personal information to us inappropriately, please contact us.

13. Your Rights

Depending on your location and the law that applies, you may have rights in relation to your personal information. Under the Privacy Act 2020, these include rights to request access, request correction, and complain to the Privacy Commissioner.

We may need to verify your identity before processing a request. If your request relates to personal information controlled by one of our clients, we may direct you to that client or coordinate with them as appropriate.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our services, operations, technology, legal obligations, affiliate program structure, or privacy practices.

If we make material changes, we may notify users by appropriate means, such as updating the "Last Updated" date, posting an updated version on our website or portal, or sending email or in-platform notice where appropriate.
